These Terms of Use (hereinafter referred to as 'Terms') govern the use of the disposable phone number subscription service (hereinafter referred to as 'the Service') provided by Transcomm S.R.L. (hereinafter referred to as 'the Company'). By using the Service, you agree to be bound by these Terms. The delivery policy, refund policy, as well as the terms of use and privacy policy governing the entire website, shall be defined separately.
SCOPE OF APPLICATION
These Terms apply to all users (hereinafter referred to as 'Users') of the Service.
CONDITIONS OF USE
Proper Purpose of Use
Users may only use the Service for lawful and legitimate purposes. The use of the Service for any fraudulent or illegal activities is strictly prohibited.
If our services are used in a manner that violates the terms specified in this section and the following sections, we reserve the right to permanently suspend the user's account.
Prohibited Actions
Users shall not engage in the following actions:
- Using the Service for fraud, spamming, or any other illegal activities.
- Infringing upon the rights of others.
- Interfering with the operation of the Service.
DISCLOSURE OF INFORMATION
The Company reserves the right to disclose User information if the User violates these Terms or if there is a legitimate request from law enforcement authorities based on applicable laws.
SERVICE FEES AND REFUNDS
Refund Policy (Buying Number)
Refund requests received during the phone number is active will typically be processed for a 100% refund and is automatically processed.
Refund Policy (Top-up)
Refunds will be processed only if claims are made in accordance with our refund policy. Our refund policy can always be referenced at https://www.smsonline.cloud/member/refund-policy.
CHANGES AND TERMINATION OF THE SERVICE
The Company reserves the right to change, add, or terminate the Service with prior notice. In cases where the Service is terminated, Users may lose access beyond the notified deadline.
DISCLAIMER
The Company shall not be liable for any damages arising from the use of the Service, except in cases of gross negligence or willful misconduct by the Company.
The Company shall not be responsible for damages caused by interruptions or technical issues related to the Service.
We do not have any information regarding the phone number provider, the registered name of the phone number holder, gender, age, email address, address, or any other related details. All phone numbers are not owned by us but are provided by multiple bulk SMS providers we partnered with and our role is solely as an intermediary through an auction system.
GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Moldova. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Chișinău, Moldova.
AMENDMENTS TO THE TERMS
The Company reserves the right to amend these Terms at any time. Amendments will take effect once posted on the Company’s website. Continued use of the Service after amendments constitutes acceptance of the revised Terms.
